Boise bankruptcy attorneys helping individuals make a financial plan
Bankruptcy LawThrough a Chapter 13 bankruptcy, you can pay debts in installments over a period of three to five years under a court-ordered repayment plan. Filed individually or jointly with your spouse, Chapter 13 bankruptcy gives you a fresh financial start. Like a consolidated loan, you make payments to a trustee who distributes the money to your creditors and thereby allows you to avoid further direct contact with your creditors. Your creditors must immediately stop collection efforts, including the harassing letters and phone calls, once you have filed for bankruptcy.
Avoid home foreclosure
One of the many advantages of filing for Chapter 13 is that you can save your home from foreclosure. An automatic stay stops foreclosure from progressing as soon as you file your Chapter 13 petition. You are given the opportunity to cure delinquent mortgage payments over the course of the repayment period. The plan provides a reasonable schedule for bringing your past-due payments current so you can keep your home. Our attorneys incorporate our foreclosure knowledge to protect Idaho homeowners during the bankruptcy process.
Lowering debt payments and protecting co-debtors
Through your Chapter 13 plan, you can reschedule secured debts and pay them over the course of the repayment period, often at lower payments. You may also be able to protect co-signers of certain loans and avoid putting business partners and family members at risk of loss from your bankruptcy. The lawyers at Peterson Zeyer Law perform a complete analysis of your financial situation to strategize your best filing options.
